Terms of use
These govern this website. The software has its own licence and the hosted service will have its own agreement; nothing here changes either.
1. Scope, and what these terms are not
These terms govern your use of tokentriage.com (the “Site”), operated by INFEROPS LLC (“InferOps”, “we”, “us”), a limited liability company formed in Washington, United States. By using the Site you agree to them. If you do not, please stop using it.
They are not two other things, and the distinction matters:
- They are not a software licence. The TokenTriage software is licensed under Commercial licence, in the licence file distributed with it. Your rights to use, modify and redistribute the software come from that licence, not from this page, and nothing here narrows it.
- They are not a service agreement. There is nothing here about fees, uptime or support entitlements, and there never will be: the hosted plane — announced, and not yet open — is governed by its own agreement, which is versioned, which you accept at signup, and which records the version you accepted. This page has no acceptance record and no version anyone can be held to, so it is not an instrument that could govern a paid service. Where the two would ever appear to disagree about the hosted service, that agreement governs and this page does not.
2. Using the Site
You may read the Site, and use what it publishes, for any lawful purpose. Please do not:
- break into it, probe it for vulnerabilities outside the terms of our security page, or interfere with anyone else’s use of it;
- scrape it in a way that degrades it for others — a reasonable, rate-limited crawl is fine, and if you need the data in bulk, ask us and we will point you at a cleaner route;
- misrepresent your relationship with us, or use our name or logo in a way that suggests we endorse, supply or are affiliated with something we are not;
- use the Site to do anything unlawful, or to help anyone else do so.
We may restrict or block access if we reasonably believe one of these is happening. The Site itself has no accounts, so this is a technical measure rather than a disciplinary one. Access to the hosted plane is a separate question and it is not open yet; when it opens, its own agreement governs suspension and termination there, not this paragraph.
3. Our content
The text, design, diagrams, illustrations and code that make up the Site are owned by us or our licensors and protected by copyright. “TokenTriage” and our logo are our trademarks.
You may quote from the Site with attribution and a link — that is ordinary fair use and we encourage it. You may not republish substantial portions as your own, or use our marks in a way that implies endorsement or affiliation.
4. Data we publish
The Site publishes machine-readable exports of model and pricing data. You may use them — including commercially — for analysis, research, comparison and reporting, provided you do not present them as your own original research and you do not imply we endorse your conclusions. Where that data derives from a provider’s own published rates, their terms may also apply to it, and we do not purport to grant rights we do not hold.
Attribution is appreciated, not required. A link back to the Site is the usual courtesy.
5. Accuracy — read this one
A large part of this Site is reference data: model prices, provider capabilities, benchmark figures, and calculators built on top of them. We work hard on making it correct, we publish how each figure was derived, and we mark estimates as estimates. None of that makes it a guarantee.
- Prices change without notice. Providers revise rates, retire models and alter terms on their own schedule. A price here reflects what we recorded when we recorded it, and the date is shown alongside it.
- Estimates are estimates. Every calculator asks you to supply assumptions about your own traffic, and its output is only as good as those assumptions. It is a projection, not a measurement, and the pages say so where it applies.
- Your provider’s invoice is the authority. Not this Site. If the two disagree, theirs is correct and we would genuinely like to hear about it so we can fix ours.
Do not treat anything here as financial, legal, procurement or engineering advice. Decisions about what to buy and what to run are yours, and you are responsible for validating the numbers against your own sources before you act on them.
6. Third-party links and services
The Site links to provider documentation, third-party tools and vendor pages, and embeds a third-party scheduler and mailing-list form. We do not control any of them and we are not responsible for their content, availability or practices. Your use of them is governed by their terms. The ones that can receive your data are named on our subprocessors page.
7. No warranty
The Site is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory — including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any information on it is complete or current.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
8. Limitation of liability
To the fullest extent permitted by law, InferOps and its members, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to your use of the Site — whether in contract, tort (including negligence), strict liability or otherwise, and even if we have been advised of the possibility.
Our total aggregate liability arising out of or relating to the Site will not exceed one hundred United States dollars (US$100). The Site is provided free of charge; this cap reflects that.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence.
9. Indemnity
You agree to indemnify and hold InferOps harmless from any claim, demand, loss or expense (including reasonable legal fees) arising from your unlawful use of the Site or your breach of §2.
10. Changes
We may change the Site at any time, including removing pages or data. We may also update these terms; when we do, the effective date at the top changes and the revised version applies from the date it is posted. Continuing to use the Site after that means you accept the revision.
11. Governing law and venue
These terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in King County, Washington for any dispute arising out of or relating to them, and each of us waives any objection to venue there.
If any provision of these terms is held unenforceable, the rest remain in force and the unenforceable provision is limited to the minimum extent necessary. Our failure to enforce a provision is not a waiver of it.
